Legal Advisor
Rate: £21.56 per hour
Hours: 36 hours per week
Key Duties:
-To provide a professional, responsive and effective legal advice service as directed by the Head of Legal Administration.
-To manage an assigned caseload in order to protect and further the objectives of internal departments and to ensure the policies and decisions are carried out accurately and within timescale.
-To provide professional and timely legal advice on matters relating to the functions and exercise of the powers and duties, including the interpretation of legislation and requirements of administrative law and contractual and conveyancing matters to Council Officers and elected
members.
-To undertake legal research and drafting of legal documentation, maintaining an index of useful cases and drafts for departmental use.
-To deal with such enquiries from service areas, outside agencies, external solicitors, elected members and members of the public as they relate to legal aspects of the functions
- To prepare, issue, monitor and advise on legal documentation including but not limited to Contracts, Tenders, Service Level Agreements, Deeds of Charge, Summonses, Warrant Applications, Letters of Offer, Leases and Licenses.
-To safeguard land and property and to investigate and assist with the defence of adverse possession claims and possessory title applications, regularising title as required.
-To be responsible for obtaining land valuations from service provider and monitoring the provision of valuation services against the service level agreement in place.
-To instruct Legal Services provider as necessary seeking specialist legal advice and to monitor the provision of legal services against the service level agreement in place.
-To support the Head of Legal Administration in the transfer, letting, acquisition and disposal of Council land and property assets.
-To be responsible for the compilation and updating of a Corporate Asset Register and Rent Register and give professional legal advice on land ownership and title.
-To seal documents in line with Standing Orders and relevant legislation and to keep updated the Sealing Register.
- To be responsible for the repeal and making of byelaws, maintaining a byelaws Register and providing professional and timely specialist advice to staff in relation to the interpretation and enforcement of the byelaws.
- To be responsible for implementation and management of a system to process requests to use land and advertise on land, coordinating and consulting with internal and external departments where necessary.
-To accompany Officers and elected members to meetings with external bodies and negotiate in relation to contractual and other matters.
- To be responsible for the safekeeping and updating of Title documents.
-To manage the first registration of land including making appropriate applications to Land Registry and coordinating the preparation of to-scale maps for first registration purposes.
- To manage Corporate Landweb Direct Account including maintaining an up to date record of users, registering new users and facilitating account credits.
Essential Criteria:
- A degree in Law OR In lieu of a law degree, a degree in any other subject plus a post degree legal qualification e.g. Graduate Diploma in Law (GDL).
-A minimum of 1 year’s experience providing legal advice in both conveyancing and contract law to include drafting, interpreting, negotiating and providing advice on contracts and other legal agreements.
-1 year’s experience in the analysis and interpretation of maps and site layout drawings.
-Competence in the use of all Microsoft Office packages including Word and Excel.
-Hold a full valid driving licence and have access to transport to meet the requirements of the post; OR
Have access to a mode of transport that will enable the post holder to fulfil the role in full. (It should be noted that the post will involve travel across the district on a regular basis).
-.Ability to work outside of normal office hours, including evenings, weekends and public/bank holidays.
